California Law allows you to clear your criminal conviction by withdrawing your plea and having the case dismissed, under most circumstances. This means you can answer "No" to a question regarding convictions in most situations.

The expungement law, California Penal Code § 1203.4, is somewhat complex in areas, but expungement of a criminal record is something that should be done by anyone with even a minor criminal history. Contrary to popular belief, records are not cleared automatically with the passage of time.

California Expungement Options:

• Expunge the conviction;

• Reduce a conviction from felony to misdemeanor;

• Seal Diversion (1000 PC) or 'DEJ' records;

• Early release from Probation;

• Marijuana (non Trafficking) Records Purged;

• Sealing and destruction of a juvenile record;

• Expunge a California DUI case;

Both Misdemeanor and Felony convictions can be expunged. As of January 2011, certain non-traffic Infractions can also be expunged.

Fees are reasonable, competitive, and include all legal work, Court costs and Court appearances; you usually do not need to appear in court.

A NOTE ON CALIFORNIA EXPUNGEMENT AND THE INTERNET

Some Attorneys with very little experience, and other sites that feature paralegals or 'form fillers', now market expungement services online. Many of their websites are inaccurate, contain false promises, and reveal a real lack of experience in court. Check to see if the attorney and his or her experience is prominently listed on the site- if not there is probably a reason. Remember that you are hiring a lawyer for a proceeding that is very important to your future, and carefully examine the experience and background of any attorney you employ.
